For Ricky H., finding a job in this economy wasn’t easy. Having a criminal record and no driver’s license didn’t help.

Even when a Titusville golf course hired him as a mechanic, the 51-year-old still needed a way to get to work. Public transportation was sporadic, and he couldn’t car pool. So Ricky, who wanted to help provide for his wife as she underwent cancer treatments, turned to a motorized bicycle.

For $163, he purchased a beach cruiser at Wal-mart and then added a gasoline motor he bought online. He assembled his new wheels himself. Ricky, who suffers from heart problems, thought it was a quick and effortless way to commute — and a legal method to skirt licensing requirements.

But, like many Brevard County residents who use motorized bicycles, Ricky wasn’t aware he was breaking the law.

Electric- and gas-powered bicycles have gained popularity in recent years as fuel prices have risen, but because of laws that are, in some places, unspecific and because dealers might falsely claim they’re allowed, some operators have found themselves in jail. Police officers and prosecutors take a hard line on people riding them, especially those without a license.

Ricky, who lost his license four years ago and was imprisoned because of a DUI conviction, was arrested last month after a state trooper spotted him riding on Cheney Highway. In addition to operating the bicycle without a license or registration, he could face charges of violating probation.

“He’s had a heart attack, so this made it a little easier to get around,” said his brother-in-law. “We’re not making excuses for what he’s done in the past, but he was trying to better himself.

“It’s just really messed up.”

A perfect example of how difficult it is to get out of the system once you’re in, especially without the help of an attorney. If you would like to discuss your DUI charge, the consequences of a conviction or another related matter, contact Musca Law’s Brevard County DUI attorney for a free and confidential legal consultation right now.

Booze-on-the-beach restrictions form a geographic patchwork quilt along the Space Coast, practically requiring sunbathers to consult maps before cracking open Coors Lights.

But outside of the boisterous Cocoa Beach spring-break and summer-weekend scene, barrier-island officials report few alcohol-fueled problems on the sand.

And though prohibitions are on the books — like those banning dogs on the beach — they are routinely ignored and rarely enforced.

Asked about recent alcohol-related incidents on his beach, Satellite Beach Police Chief Jeff Pearson replied, “I’ll bet I can count them on one hand in the 24 years I’ve been here.”

A Satellite Beach ordinance prohibits consumption of alcoholic beverages on city property, including beaches, without a permit.

“You’re not allowed to drink on the beach. But we’re not going to make people get permits if they’re two people who are going to sit on the beach and go fishing at night,” Pearson said.

“We don’t go down there and look for it. We’re patrolling the beaches — but we don’t look in people’s coolers,” he said

Paul Gougelman serves as town attorney for Indialantic and Melbourne Beach. Throughout the decades, he said Space Coast communities debated drinking regulations after major problems or incidents arose.

Gougelman likened these ordinances to “tools” for police officers and sheriff’s deputies to use when dealing with troublemaking beach visitors.

In May, the Melbourne Beach Town Commission unanimously approved first reading of an ordinance banning booze from the beach. But after residents objected, commissioners unanimously shipped the idea back to the drawing board in June.

Melbourne Beach Police Chief Dan Duncan said his department has filed only 115 alcohol-related charges — including DUIs — since January 2007. That’s about two charges per month.

After rejecting a beach-alcohol ban, town commissioners will vote instead Wednesday on prohibiting open containers from commercial parking lots.

Indian Harbour Beach Police Chief Bobby Sullivan could not recall any alcohol-related problems in recent years on the sand in his 2-square-mile community.

Robert Lefever, Cape Canaveral parks and recreation director, said his city’s younger residents tend to gravitate toward neighboring Cocoa Beach. He said his city’s beach-related issues are overflowing trash cans at Cherie Down Park and parking shortages, not people partying on the sand.

“We don’t have the activity that they have in Cocoa Beach because we don’t have the beachfront bars and restaurants. It’s not been a negative effect for Cape Canaveral,” Lefever said.

In December 2006, the Cape Canaveral City Council approved an ordinance preventing future businesses from selling alcohol within 300 feet of the Atlantic Ocean or Banana River.

Indialantic doesn’t allow drinking at most beach areas, but police are required to first issue verbal warnings and allow “reasonable opportunity to comply” before pressing charges against beach drinkers, Sgt. Mike Casey said.

Casey said his department makes a few such arrests every year, mostly to troublemakers and vagrants.

“We try to keep it a family atmosphere down there,” he said.

A 19-year-old Satellite Beach woman was hospitalized early this morning after trying to flee from local deputies and eventually crashing in Orange County, officials said.

The Brevard County Sheriff’s Office said Amber W. had struck a pedestrian in Cape Canaveral, then left the scene. Deputies spotted her 1997 Saturn coupe on westbound State Road 528 near Banana River Drive.

Twice between that point and U.S. 1, deputies set out spikes on the Beachline, trying to disable the vehicle. A helicopter began following the car.

“They spotted the vehicle with a DUI-type driving pattern,” said Lt. Alex Herrera, a sheriff’s spokesman. “They were able to successfully deploy the stingers twice, but she kept going.”

Florida Highway Patrol troopers took over the chase as the car reached State Road 520. When the Saturn took the exit toward International Corporate Parkway about 2:50 a.m., the FHP said Amber failed to negotiate the curve. Her coupe went off the road, spun sideways and flipped.

Firefighters extricated Amber from the car and took her to Orlando Regional Medical Center. She suffered serious injuries in the wreck.

Amber has several misdemeanor and felony arrests, mainly relating to theft and the consumption of alcohol by a minor. The FHP said charges in Wednesday morning’s incidents will depend on the results of blood testing.

Amber had a suspended learner’s permit.

Updates as they are available.

Police said 19-year-old Amber W. hit a pedestrian and then fled from the scene, leading authorities on a pursuit spanning two Central Florida counties before crashing.

Amber was taken to Orlando Regional Medical Center early Wednesday after her car crashed and flipped while exiting the Beachline in Orange County.

According to Brevard County deputies, Amber is suspected of hitting a pedestrian on State Road A1A in Cape Canaveral around 2 a.m. and driving off. The pedestrian was not seriously injured.

Deputies said Amber was later spotted driving erratically on the Beachline in Brevard County and authorities tried to pull her over on suspicion of DUI.

A pursuit began, and deputies used Stop Sticks to try to stop the vehicle twice, but Amber kept driving westbound on the Beachline on flat tires for several miles, the Sheriff’s Office said. As she exited at ICP Boulevard, her car overturned, landing on its roof.

Amber was taken to the hospital, but she could be charged in the hit-and-run crash, along with aggravated fleeing and eluding and DUI.

FHP troopers said Amber has a suspended learner’s permit. She is expected to fully recover.

Analysis: It’s almost always best to stay put when you get into an accident, even if you are drunk. Remember, it’s you against a full force of police and any witnesses to the incident. If you are caught fleeing, you will face much harsher penalties and it will be much more difficult for your Brevard County DUI attorney to achieve a not-guilt conviction.

A teen was arrested for driving under the influence of alcohol Sunday by the Florida Highway Patrol following a vehicle accident, the FHP reported Wednesday.

Kayla G., 19, Mayo, was arrested for DUI, failure to use due care and failure to use a seatbelt.

According to the FHP, Kayla was traveling south on Sunny Oaks Road around 1:20 a.m. at CR 300 at an unsafe speed in a 1994 Ford pickup. The Ford rounded a curve and left the road onto the right shoulder where it struck a fence with its right front. The Ford continued traveling south where it struck a tree with its right front. The Ford then crossed a driveway and struck a second fence before coming to a final rest.

Kayla, nor passenger Preston P., 21, Mayo, suffered any injuries, the FHP reported.

Preston was also charged with failure to use a seatbelt, the FHP reported.

Although a DUI charge is already a serious offense, Kayla is fortunate she wasn’t charged with property damage, as well. However, she would still be well advised, along with anyone else who has recently been charged with DUI, in contacting a Brevard County DUI attorney at Musca Law right now.

An Alabama man has been sentenced to five years and two months in prison after his 10th DUI conviction.

Fifty-four-year-old Michael M. Naramore of Mountain Brook, Ala., was sentenced Wednesday in Pensacola federal court. He pleaded guilty May 16 to driving under the influence and driving with a suspended license.

The Pensacola News-Journal reports that Naramore’s driving history includes 13 DUI arrests and nine prior DUI convictions in Alabama.

The Florida case stems from a Nov. 24 arrest at the west gate of Eglin Air Force Base.

A U.S. Attorney’s statement says Naramore reeked of alcohol.

If you’re facing DUI charges in Brevard, whether it’s your first charge or not, it’s very important that you consult with a defense attorney. If you are convicted, which a Brevard County DUI attorney may be able to help you avoid, it could end up costing you educational and career opportunities later.

A Brevard County school bus driver was injured after a bus carrying high school students ended up in a pond on Wednesday morning, according to officials.

The Florida Highway Patrol said the bus driver, 67-year-old Ronald B., had a medical episode and passed out before driving the front end of the bus into the pond near Crane Creek Boulevard at Murrell Road in Melbourne.

Officials said the crash happened at around 8:15 a.m. Officials said the bus drove over four lanes of traffic before crashing into the pond. No one was hit.

Former U.S. Congressman Tim Mahoney was arrested on a DUI charge after police said they found him sleeping in his parked car on a South Florida road early Saturday.

Mahoney, a Democrat who filled former Congressman Mark Foley’s seat, was sleeping behind the wheel around 3 a.m. Saturday in Palm Beach Gardens, police said. Fifty-four year-old Mahoney was charged with DUI “based on the investigation and after talking to the driver,” Palm Beach Gardens Police Commander William Brandt said.

No other details were given. Mahoney, a multimillionaire venture capitalist, was released on his own recognizance Saturday morning, according to a jail spokeswoman.

A telephone message left for Mahoney was not immediately returned Saturday.

It’s the second scandal to rock Mahoney in recent years. The political newcomer who ran on a family values platform lost his re-election bid in 2008 after revealing he’d had several affairs and put one of his lovers on the federal payroll as a congressional staffer. She later became a campaign worker.

He then fired her – he says for performance issues – and paid her $121,903 to keep her quiet and avoid a sexual harassment lawsuit.

Mahoney has insisted he broke no laws. His wife later filed for divorce.

Mahoney also acknowledged a 2007 affair with a high-ranking Martin County official in his district around the time he successfully lobbied the Federal Emergency Management Agency to give the county a $3.4 million hurricane cleanup reimbursement.

Florida’s 16th District, which spans parts of eight counties from Palm Beach County westward toward the Gulf, has been a magnet for sex scandal in recent years.

Republican Mark Foley resigned from Congress in 2006 amid revelations that he sent lurid Internet messages to male pages who had worked on Capitol Hill as teenagers.

If you’ve too been charged with DUI, you probably have much more at stake then Mr. Mahoney does. While you may be in jepordy of losing your license, job and much more upon being convicted, you do have the option of fighting the charge(s).
